FULL SERVICE TERMS
Consultation, Proposal, and Agreement
The consultation helps define the project but does not reserve production time. Before work begins, Cultura provides a written proposal or service agreement identifying scope, measurable limits, deliverables, price, deposit, estimated schedule, included revisions, and special conditions. The signed agreement controls if it differs from this website summary.
Scope and Change Orders
Only services and deliverables listed in the signed agreement are included. Added interviews, extensive rewriting, new research, replacement of substantial media, restoration, additional formats, increased item counts, or other out-of-scope work may require a written change order, revised price, and adjusted schedule.
Interviews and Participation
Interviews are recorded only with participant permission. Participants may decline questions or request a pause. The booking client identifies the authorized decision-maker and final approver. The client is responsible for resolving conflicting instructions among relatives, participants, representatives, or organizational stakeholders.
Personal Recollections and Accuracy
Life Stories preserve personal recollections and are not automatically independently verified histories. Cultura may correct grammar, reduce repetition, and organize material while preserving intended meaning. Clients and participants are responsible for reviewing names, dates, quotations, allegations, captions, and factual claims before final approval. Historical or genealogical verification is included only when expressly contracted.
Client Materials and Permissions
Clients supply accurate names, dates, captions, photographs, documents, recordings, data, and background information. Clients confirm that they own submitted materials or have permission to use them. Cultura does not provide legal, medical, genealogical, or historical certification unless separately contracted and qualified to do so.
Privacy and Portfolio Use
Interviews, records, and family or organizational materials are treated as private project content. Cultura will not publish client materials, identify participants, display completed work, or use project content in advertising without separate written permission. Any portfolio or example use is governed by the applicable release.
Ownership and Permitted Use
Clients retain ownership of their original materials. Ownership of Cultura’s writing, narration, editing, layouts, metadata, and production files—and the client’s permission to copy, share, display, or reproduce finished work—is defined in the signed agreement. Final unrestricted deliverables may be withheld until the agreed balance is paid.
Revisions and Approval
Only the revisions stated in the selected proposal are included. Unless otherwise agreed, the client provides one consolidated response per review round. Additional revisions, new directions, or approvals delayed beyond the agreed review period may require a change order. Final approval is documented according to the signed agreement.
Payments, Cancellations, and Refunds
Deposits, payment milestones, cancellation charges, and refund eligibility are stated in the written agreement. Fees earned for completed interviews, transcription, writing, editing, narration, research, digitization, licensed assets, printing, travel, or committed third-party costs may be nonrefundable to the extent stated in that agreement.
Scheduling and Event Deadlines
Delivery dates are estimates unless a specific deadline is accepted in writing. Memorial, anniversary, publication, or event deadlines must be disclosed before booking. Rush fees may apply. Delays in interviews, decisions, approvals, payments, access, or client-supplied materials may extend delivery.
Printing, Tangible Goods, Travel, and Third Parties
Printed books, prints, USB drives, storage media, shipping, licensed media, travel, venue services, and other tangible goods or third-party costs are included only when written into the proposal. Tangible products may be subject to applicable sales tax.
Music, Venues, Devices, and Platforms
Music is used only when appropriately licensed, supplied with permission, or selected from an approved source. Cultura cannot guarantee playback or compatibility on every device, venue system, platform, or future software version.
Delivery, Backup, and Retention
Clients should download and back up all final files promptly. The service agreement states the delivery method and any temporary retention period. Cultura is not a permanent storage provider unless archival storage is separately contracted.
Plain-Language Notice
These website terms describe general service practices and are not legal advice. A project-specific written agreement and any signed interview, materials, privacy, or portfolio releases establish the parties’ final obligations.
